Ted Cruz will oppose President Donald Trump\u2019s nominee for the 5th Circuit Court of Appeals, Halil Suleyman \u201cSul\u201d Ozerden, a major setback for the embattled nomination.<\/p>\n<p>Cruz (R-Texas) has informed the White House and colleagues this week that he will oppose Ozerden, according to three people familiar with the Judiciary Committee\u2019s internal dynamics. That conservative opposition places in doubt the future of Ozerden, who is a close friend of acting White House chief of staff Mick Mulvaney, and whose nomination Mulvaney pushed over the objections of the White House Counsel&#8217;s office.<\/p>\n<p>\u201cFor a lifetime appointment on the court of appeals, I believe we should be looking for someone with a strong, demonstrated record as a constitutionalist. I have significant concerns that Judge Ozerden\u2019s judicial record does not indicate that he meets that standard. For that reason, I do not believe he should be on the court of appeals, and I will oppose his nomination,&#8221; Cruz said in a statement for this story.<\/p>\n<p>The Senate Judiciary Committee has held a hearing for Ozerden but has not yet held a committee vote. Republicans are split on whether he will move forward: Some believe the White House may have to withdraw the nomination, others want to push him through despite reluctance among conservatives about Ozerden.<\/p>\n<p>Other undecided senators are digging into the nomination. Sen. Josh Hawley (R-Mo.) met with Ozerden on Thursday morning and Sen. John Kennedy (R-La.) said he was undecided on the nomination. But the Mississippi judge got a boost Thursday from Sen. Mike Lee (R-Utah) who decided to vote for his nomination after meeting with Ozerden, according to Lee&#8217;s spokesperson.<b> <\/b><\/p>\n<section class=\"content-groupset pos-beta\">\n<div class=\"content-group story-core\">\n<div class=\"story-text \" data-disable-viewport-ad=\"false\">\n<p>Senate Judiciary Chairman Lindsey Graham (R-S.C.) also said he&#8217;s a &#8220;yes&#8221; on Ozerden. He said he was unsure if the nominee will get a favorable vote in committee but that &#8220;he deserves a vote.&#8221;<\/p>\n<p>As a district judge, Ozerden approved the Obama administration\u2019s dismissal of a challenge to the Affordable Care Act\u2019s contraception coverage mandate, deeming the challenge premature. Senate Republicans have expressed concern about Ozerden\u2019s decision in 2012.<\/p>\n<p><ins class=\"adsbygoogle\" data-ad-client=\"ca-pub-8279698647515158\" data-ad-slot=\"Teads_Passback\" data-adsbygoogle-status=\"done\"><ins id=\"aswift_0_expand\"><ins id=\"aswift_0_anchor\"><iframe id=\"aswift_0\" name=\"aswift_0\" width=\"1\" height=\"1\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\" data-mce-fragment=\"1\"><\/iframe><\/ins><\/ins><\/ins>Unlike most other Trump judicial nominees, Ozerden lacks explicit backing from conservative judicial groups like the Judicial Crisis Network.<i> <\/i>Carrie Severino, the group&#8217;s chief counsel, wrote last year that &#8220;we could do better than Judge Ozerden&#8221; in Mississippi.<\/p>\n<p>Senate Majority Leader Mitch McConnell (R-Ky.) declined to comment about Ozerden, as did the White House.<\/p>\n<p>The Trump administration and McConnell have made confirming judges a major priority, clinching their 150th lifetime confirmation on Wednesday. But those successes are occasionally marred by setbacks, and Ozerden isn\u2019t the only judicial nominee hanging in the balance.<\/p>\n<p>Steven Menashi, a nominee to the 2nd Circuit Court of Appeals, frustrated senators in both parties Wednesday when questioned about his writings as well as his refusal to answer questions on his role shaping the White House\u2019s immigration policy. He obtained his undergraduate education at Edmund A. Walsh School of Foreign Service at Georgetown University in Washington, D.C., receiving a Bachelor of Science in Foreign Service. Sul was also a four-year Navy ROTC scholarship student, serving as battalion executive officer (1989). Upon receiving his commission as a naval officer, he completed United States Navy Flight School in Pensacola, Florida, from 1989 to 1990, and was designated a naval flight officer. Ozerden also obtained his Juris Doctor in 1998 from Stanford Law School, and served as associate editor for the <i>Stanford Law Review<\/i>.<\/p>\n<h2><span id=\"Professional_career\" class=\"mw-headline\">Professional career<\/span><\/h2>\n<p>Ozerden served as a commissioned officer in the United States Navy from 1989 to 1995. His military service included: naval flight officer\/bombardier-navigator, A-6E Intruder; over 1,000 flight hours; mission commander qualified; two six-month Western Pacific deployments aboard the USS <i>Kitty Hawk<\/i>; head of Safety Department; Navy Commendation Medal for missions flown in Operation Restore Hope (Somalia) and Operation Southern Watch (Iraq); and the Navy Achievement Medal. He was honorably discharged with the rank of lieutenant (O-3).<\/p>\n<p>Ozerden began his legal career as a law clerk for United States District Judge Eldon E. Fallon of the Eastern District of Louisiana from 1998 to 1999 and also served as a private practice attorney licensed in Mississippi from 1999 to 2007.<\/p>\n<h2><span id=\"Federal_judicial_service\" class=\"mw-headline\">Federal judicial service<\/span><\/h2>\n<p>On the recommendation of United States Senators Thad Cochran and Trent Lott, President George W. Bush nominated Ozerden to be a United States District Judge for the Southern District of Mississippi on January 8, 2007. He was confirmed by the United States Senate by a vote of 95-0 on April 24, 2007 and received his commission on May 1, 2007.<sup id=\"cite_ref-1\" class=\"reference\">[1]<\/sup><\/p>\n<h3><span id=\"Nomination_to_appellate_court\" class=\"mw-headline\">Nomination to appellate court<\/span><\/h3>\n<p>On June 11, 2019, President Trump announced his intent to nominate Ozerden to serve as a United States Circuit Judge for the United States Court of Appeals for the Fifth Circuit.<sup id=\"cite_ref-WHBio_2-0\" class=\"reference\">[2]<\/sup> On June 24, 2019, his nomination was sent to the Senate. He is nominated to the seat vacated by E.
