Turkey, a<br \/>\nParty to the Convention since 2000, has yet to implement key elements of<br \/>\nthe Convention, including introducing corporate liability for the bribery<br \/>\nof foreign public officials and effectively enforcing its foreign bribery<br \/>\noffence.<\/p>\n<p>The Working Group recommends carrying out another on-site visit to Turkey<br \/>\nwithin one year to check on progress by the Turkish authorities to remedy<br \/>\nthese and other issues.<\/p>\n<p>Turkey, for example, repealed corporate criminal liability for the offence<br \/>\nof foreign bribery in 2005 and replaced it with &#8220;security measures&#8221; that<br \/>\ndo not meet the standards of the Convention. In addition, Turkey dismissed<br \/>\nan investigation of a foreign bribery case allegedly involving a Turkish<br \/>\nholding company and Turkish nationals in another country, for reasons that<br \/>\ndo not satisfy the Working Group. The case resulted in charges against the<br \/>\npresident of the company and several other company officials in the other<br \/>\ncountry. Turkey also took two years to act on allegations of illicit<br \/>\npayments to the Iraqi government by 139 Turkish companies in the United<br \/>\nNations Oil-for-Food Programme.<\/p>\n<p>In addition to recommending that Turkey urgently rectify these problems,<br \/>\nthe Working Group recommends that Turkey:<\/p>\n<p>Repeal a provision in the Turkish Criminal Code that releases offenders<br \/>\nfrom penalties for the foreign bribery offence in exchange for having<br \/>\nreported the offence to the law enforcement authorities;<\/p>\n<p>Expressly deny the tax deductibility of bribes to foreign public officials<br \/>\nin the tax law; and<\/p>\n<p>Urgently establish awareness-raising programmes on foreign bribery for the<br \/>\nTurkish public and private sectors.<\/p>\n<p>The Working Group recognised that Turkey took an important step by<br \/>\namending its foreign bribery offence in 2005. Progress on certain<br \/>\nsupplementary issues include efforts made by T|rk Eximbank, Turkey&#8217;s<br \/>\nofficial export credit support agency, MASAK, Turkey&#8217;s financial<br \/>\nintelligence unit, and the Ministry of Finance, to publicise the<br \/>\nConvention. T|rk Eximbank has also undertaken training and informational<br \/>\nactivities for staff and applicants for export credit support. Other<br \/>\ninitiatives include the preparation of regulations by MASAK to improve<br \/>\nsuspicious transaction reporting of money laundering transactions, the<br \/>\nsubmission to Parliament of a draft Witness Protection Act, and an<br \/>\ninitiative to bring Turkish accounting standards in line with<br \/>\nInternational Accounting Standards.<\/p>\n<p>The Phase 2 Report on Turkey lists the Working Group&#8217;s recommendations to<br \/>\nTurkey on pages 62-66, includes an overview of the findings of the Working<br \/>\nGroup in the Phase 2 examination, and describes specific legal and policy<br \/>\nfeatures in Turkey for combating the bribery of foreign public officials.<br \/>\nThe future report on Turkey&#8217;s additional examination will also be<br \/>\npublished. In addition, as with all other OECD Working Group members,<br \/>\nTurkey will orally report to the Working Group on its actions to implement<br \/>\nthe Working Group&#8217;s recommendations after one year.
